Terms and Conditions

The terms governing your use of the UPCC website, courses, member portal, and certification programmes.

Welcome to United Pickleball Coaching & Certification ("UPCC", "we", "us" or "our").

These Terms & Conditions apply to your use of the UPCC website, registration for UPCC courses and programs, participation in UPCC certification, membership, use of UPCC accounts and services, and other interactions with UPCC.

By using our website, creating an account, purchasing or registering for a course, or participating in a UPCC program, you agree to these Terms & Conditions.

1. UPCC Services

UPCC provides pickleball coaching education, coach certification, professional development, memberships, events and related services in Australia and internationally.

Course content, delivery methods, locations, facilitators, schedules and requirements may vary between programs and countries.

2. Website Accounts

Certain UPCC services may require you to create an account.

You agree to:

  • Provide accurate and current information
  • Keep your login details secure
  • Not allow another person to use your account without permission
  • Notify UPCC if you believe your account has been accessed without authorisation.

You are responsible for activity occurring through your account where that activity results from your failure to keep your login credentials secure.

UPCC may suspend or restrict an account where we reasonably believe there has been misuse, fraudulent activity or a serious breach of these Terms.

3. Course Registrations

Course places are subject to availability.

A registration is confirmed once the required registration process and payment have been successfully completed, unless otherwise advised by UPCC.

Participants are responsible for ensuring that the information provided during registration is correct.

UPCC may establish prerequisites, minimum ages, experience requirements or other eligibility criteria for particular courses or certification levels.

4. Course Fees and Payments

Course fees are displayed during registration or otherwise communicated by UPCC.

Prices may vary depending on:

  • Course level
  • Country
  • Location
  • Currency
  • Venue
  • Program type
  • Promotional offers.

Payment must be made using an approved payment method.

Any applicable taxes, fees or charges will be displayed or communicated where required.

UPCC reserves the right to change pricing for future courses. A pricing change will not ordinarily affect a registration that has already been fully paid and confirmed.

5. Cancellations and Refunds

If you are unable to attend a course, you should contact UPCC as soon as possible.

Eligibility for a refund, credit or transfer may depend on how much notice is provided, costs already incurred by UPCC and the circumstances of the cancellation.

Where possible, UPCC may allow a participant to transfer to another available course rather than cancel their registration.

No-show participants or participants who withdraw after a course has commenced may not be entitled to a refund except where required by applicable consumer law.

Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.

6. Course Changes or Cancellation by UPCC

UPCC may occasionally need to:

  • Change a course date or time
  • Change a venue
  • Replace a facilitator
  • Modify course arrangements
  • Postpone or cancel a course.

Where a significant change occurs, UPCC will make reasonable efforts to notify registered participants.

If UPCC cancels a course and does not provide a suitable alternative, participants will be offered an appropriate remedy, which may include a transfer, credit or refund, subject to applicable law.

UPCC is not responsible for indirect costs such as flights, accommodation or other travel expenses except where liability cannot legally be excluded.

Participants travelling to attend a UPCC course are encouraged to use flexible or refundable travel arrangements.

7. Certification

Registration for or attendance at a UPCC course does not automatically guarantee certification.

To receive certification, participants must successfully complete the requirements established for the relevant UPCC course.

Requirements may include:

  • Attendance
  • Practical participation
  • On-court assessment
  • Demonstration of required coaching competencies
  • Completion of required course activities
  • Compliance with UPCC coach standards.

Where a participant does not meet the required standard, UPCC may require further assessment, training or other reasonable steps before certification is issued.

UPCC's certification decisions are based on the requirements and assessment standards applicable to the relevant course.

8. Certificates and Certification Records

UPCC maintains records of completed certifications.

Certificates may be provided electronically through the UPCC website or certification platform.

Participants are responsible for ensuring that the personal information displayed on their certificate is correct.

UPCC may provide a certification verification system that allows third parties to confirm whether a UPCC certification is valid.

UPCC may correct, suspend or revoke a certification where it was obtained through fraud, false information, serious misconduct or another substantial breach of UPCC certification requirements.

9. Membership

Certain UPCC certifications, services or benefits may include or require UPCC membership.

Where a membership fee, renewal period or automatic renewal applies, these details will be disclosed during registration or before the relevant membership purchase.

Where automatic renewal is offered, members will be provided with information regarding the renewal arrangement and how to cancel or manage their membership.

Membership benefits, services and features may evolve over time.

Nothing in this section limits rights available under applicable consumer law.

10. Participant Conduct

UPCC is committed to providing a safe, professional and respectful learning environment.

Participants must:

  • Treat facilitators, participants, venue staff and members of the public respectfully
  • Follow reasonable safety instructions
  • Use equipment and facilities appropriately
  • Avoid behaviour that creates an unreasonable risk to themselves or others
  • Avoid harassment, discrimination, bullying, threatening behaviour or serious disruption.

UPCC may remove a participant from a course or event where their conduct creates a safety risk or involves serious misconduct.

Whether a refund applies in these circumstances will depend on the situation and applicable law.

11. Health, Safety and Physical Participation

Pickleball and practical coaching activities involve physical activity and inherent risks.

Participants are responsible for determining whether they are physically capable of participating and should seek appropriate medical advice where necessary.

Participants must inform their facilitator of any relevant limitation that may affect their safe participation where appropriate.

Participants must follow reasonable safety instructions provided by UPCC facilitators and venue staff.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Intellectual Property

Unless otherwise stated, UPCC owns or is authorised to use the intellectual property associated with its courses and materials, including:

  • Course manuals
  • Training resources
  • Assessment materials
  • Presentations
  • Videos
  • Graphics
  • Logos and branding
  • Coaching frameworks
  • Website content
  • Certification materials.

UPCC course materials are provided for the participant's personal education and coaching use.

Unless written permission has been provided by UPCC, materials must not be copied, reproduced, sold, distributed, uploaded, republished or used to create or deliver competing certification or training programs.

Receiving UPCC certification does not transfer ownership of UPCC intellectual property to the participant.

13. UPCC Name and Branding

Certification as a UPCC coach does not give a person ownership of the UPCC name, logo or branding.

Certified coaches may describe themselves accurately according to their current UPCC certification status.

Use of UPCC logos, trademarks, course materials or branding must comply with any branding or licensing requirements issued by UPCC.

UPCC may require unauthorised or misleading use of its branding to cease.

14. Photos and Video

Photography or video may occur during UPCC courses, programs and events.

Where appropriate, UPCC may use approved photographs or video for educational, website, social media and promotional purposes.

Participants who have concerns regarding photography or filming should notify UPCC or the course facilitator.

Our handling of personal information and identifiable media is further explained in the UPCC Privacy Policy.

15. Third-Party Venues and Services

UPCC courses may be delivered at independently operated clubs, sporting facilities, recreation centres or other venues.

Participants must comply with reasonable venue rules while attending a UPCC program.

UPCC may also use third-party technology, payment and communication providers to deliver its services.

Third-party services may be subject to their own terms and policies.

16. International Courses

UPCC operates in multiple countries.

Local requirements, venues, currencies, course arrangements and delivery methods may differ between countries.

Participants attending international courses are responsible for their own travel arrangements, visas, accommodation and other personal travel requirements unless UPCC expressly agrees otherwise in writing.

17. Website Use

You must not use the UPCC website to:

  • Engage in unlawful or fraudulent activity
  • Attempt to gain unauthorised access to another person's account
  • Interfere with website security or operation
  • Introduce malicious software or harmful code
  • Scrape, reproduce or commercially exploit UPCC content without permission
  • Misrepresent your identity or certification status.

UPCC may restrict access where reasonably necessary to protect users, the website or UPCC.

18. Website Availability

We aim to keep the UPCC website and online platform available and operating reliably.

However, we do not guarantee uninterrupted availability.

Maintenance, technical issues, third-party outages, security requirements or circumstances outside our reasonable control may occasionally affect access.

19. Limitation of Liability

To the maximum extent permitted by law, UPCC is not responsible for indirect, incidental or consequential loss arising from use of our website, participation in our programs or circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded or limited.

20. Privacy

Personal information collected by UPCC is handled in accordance with the UPCC Privacy Policy.

Users should review the Privacy Policy to understand how personal information is collected, used, stored and disclosed.

21. Changes to These Terms

UPCC may update these Terms & Conditions from time to time to reflect changes to our services, website, certification programs, membership arrangements or legal requirements.

The current version will be published on the UPCC website with the date it was last updated.

Changes will not retrospectively remove rights that a customer has under applicable law.

22. Governing Law

These Terms & Conditions are governed by the applicable laws of Victoria, Australia, subject to any mandatory rights or laws that may apply to participants in other jurisdictions.
